The petitioner seeks bail in a case registered under Sections 365, 366A, 506 and 120B/34 of the Indian Penal Code. Niece of the informant namely Amriti Kumari @ Chhoti aged about 17 years is said to have been kidnapped by the brother of the petitioner namely Birju Sah in collusion with the petitioner and his family members.
It is submitted by learned counsel for the petitioner that petitioner has no concern with the aforesaid occurrence. There is no eye witness of the occurrence. Petitioner has been falsely implicated in this case merely because he happens to be brother of the accused Birju Sah. Petitioner has no
Patna High Court Cr.Misc. No.49654 of 2018(3) dt.20-09-2018 2/2 criminal antecedent. He has been languishing in custody since 05.05.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Simri P.S. Case No. 49 of 2018.
