2. Petitioner seeks bail who is in custody since 14.04.2025 in connection with S.T. No. 326 of 2025 arising out of Amarpur P.S. Case No. 259 of 2025 for the offences punishable under Sections 103(1), 238, 61(2) and 3(5) of the BNS, 2023.

3. According to prosecution case, this petitioner with the help of other accused persons have killed her husband.

4. Learned counsel for the petitioner submits that petitioner is innocent and she has falsely been implicated in the present case. Initially the petitioner was informant of the present case but police after investigation has found that the petitioner was involved in the present crime in question and she has been made accused in the present occurrence and except the

Patna High Court CR. MISC. No.91649 of 2025(5) dt.01-05-2026 2/2 suspicion, nothing has come during investigation which suggest the involvement of the petitioner in the present occurrence.

Learned Additional Public Prosecutor on the basis of material available on record as well as case diary has vehemently opposed the prayer for bail of the petitioner and submits that the petitioner was initially the informant of the present case but during investigation she has been made accused in the present case. Thereafter, the petitioner has confessed her guilt in the present occurrence and she has stated that she has committed murder of her husband with help of the co-accused, namely, Baleshwar Yadav and the arms which were used in the present crime in question have also been recovered by the police. Apart from that the petitioner carries one criminal antecedent other than the present one.

6. Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail in connection with S.T. No. 326 of 2025 arising out of Amarpur P.S. Case No. 259 of 2025 pending in the court of learned District & Additional Sessions Judge-II, Banka.

7. Prayer is refused.
