====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 17-09-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Special P.S. Case No. 13 of 1997 arising out of Vigilance P.S. Case No. 10 of 1997 registered for the offences punishable under Sections 109, 120(B), 201, 409, 420 and 467 of the Indian Penal Code and Section 13 (2) read with sections 13(1) (C) (A) of Prevention of corruption Act. Allegation against petitioner is of misappropriation and defalcation of the allotted money.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has no

Patna High Court Cr.Misc. No.52441 of 2018(6) dt.17-09-2018 2/2 criminal antecedent. It has been further submitted that similarly placed co-accused has been granted bail by co-ordinate Bench of this court in Cr. Misc. No. 49108 of 2013 vide order dated 06.03.2014.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance- 1st at Patna in connection with Special Case No. 13 of 1997 arising out of Vigilance P.S. Case No. 10 of 1997.
