JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-08-2018 The petitioner claims to have taken Intermediate Examination held by the Bihar School Examination Board in the year 2014. She was, however, declared 'fail', since she had obtained only 17 marks out of 100 in Hindi subject. It has been asserted that the petitioner again appeared in the Intermediate Examination, 2015 in the subject Hindi only, since she had not cleared the said paper in 2014. This time her score in Hindi is 35, but she has been declared fail, showing her absent in other papers.

Learned counsel appearing on behalf of the petitioner submits that based on her performance in Hindi subject only, her

Learned counsel for the petitioner has, however, not been able to satisfy this Court that the Regulations permit so. The petitioner claims to have filed representation before the Secretary, Bihar School Examination Board, requesting publication of her result of Intermediate Examination based on her performance in Hindi subject in 2015.

Without commenting upon the genuineness of the petitioner's claim, this writ application is disposed of with a direction to the Secretary of the Board to take decision on the petitioner's representation within a period of six weeks from the date of receipt/production of a copy of this order. It is observed that if the petitioner's claim is not found to be acceptable by the Secretary of the Board, he shall record reasons in his order. This application stands disposed of.
