The petitioners seek bail in Rupaspur P.S. Case No. 66/2018, instituted for the offences under Sections 406 and 420 of the Indian Penal Code.

It is alleged in the written report that the informant had purchased a land from petitioner no. 2 on a consideration amount and the land was mutated in the name of informant. Thereafter, the informant sold the said land to his younger sister-in-law, namely, Swastika by sale deed and her name has also been mutated. It is further alleged that after sometime, the informant received notice from the Manager of Punjab National Bank that loan of Rs. 55 lacs is outstanding against petitioner no. 1 and then informant learnt

Patna High Court Cr.Misc. No.53242 of 2018 (3) dt.27-09-2018 2/2 that both petitioners have cheated him.

Learned counsel for the petitioner has submitted that it is a matter of purely civil dispute. Aforesaid land was sold to the informant by petitioner with understanding that loan will be cleared by the informant. The informant did not clear the loan. Thereafter notice was served by the Bank. The petitioner is in custody since 22.05.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Danapur in connection with Rupaspur P.S. Case No. 66/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J.) Rakhi U T
