This application is for grant of regular bail in connection with Amba P.s.Case No.25 of 2018 dated 31.3.2018 for the offences under Sections 379 of the Indian Penal Code. Allegation against the petitioner is of theft as per the FIR and the petitioner is not named in the FIR and later on his name transpired and it appear that he is accused in five other cases also.

Submission of the learned counsel for the petitioner is that except confessional statement there is nothing against the petitioner and he is in custody for more than five months. And nothing has been recovered from his possession. Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.60361 of 2018 (2) dt.08-10-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction that once he completes further two moths in custody, he shall be released on bail in connection with Amba P.S.Case No.25 of 2018 by the learned court below to his own satisfaction with condition that he will co-operate in disposal fo the trial. With the aforesaid observation, this application is disposed of.
