JUSTICE PRAVEEN KUMAR ORAL ORDER 03-04-2026 Heard learned counsel for the petitioner and learned A.P.P for the State. Although the notice has been validly served upon O.P. No. 2, there is no representation on his behalf.
2. The petitioner has preferred this application for grant of regular bail in connection with Ramnagar P.S. Case No. 535 of 2025 registered for the offences punishable under Sections 137(2), 96 and 3(5) of the B.N.S. and Section 4 & 6 of the POCSO Act.
3. As per the prosecution case, the daughter of the informant, aged about 17 years, had gone out of the house to study but did not return by evening. A thorough search was conducted, during which it transpired that the petitioner had

It is further alleged that on 04.09.2025 at 7:00 A.M., when the informant went to the residence of Nandan Paswan (the petitioner) to inquire about his missing daughter, his family members abused him and forced him to leave their house.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It has further been submitted that the victim was not abducted rather, the victim and the petitioner were in a consensual love affair. It has been submitted that the statement of the victim girl was recorded under Section 183 of B.N.S.S., wherein she has clearly stated that she went to Kerala with the petitioner out of her own sweet will and performed marriage with him. It has next been submitted that the victim was on the verge of majority and she was not of such tender age so as to not understand the consequences of her action. It has also been submitted that there is no allegation of physical/sexual assault against the petitioner. It has lastly been submitted that the petitioner has clean criminal antecedent and is in custody since 15.09.2025.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid submissions of the parties and taking into account the facts and circumstance of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, West Champaran, in connection with Ramnagar P.S. Case No. 535 of 2025.
7. The application stands allowed.
