====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 01-11-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Special Case No. 04 of 2013 arising out of C.B.I./ACB/R.C. 3(A)/ 2013 registered for the offences punishable under Sections 120(B), 420/468 and 471 of the Indian Penal Code and under Section 13(2) and 13(1)(d) of Prevention of Corruption Act, 1988.

Allegation against petitioner is of appointing candidates as Gramin Dak Sevak in the Department of Post on the basis of fake educational testimonial issued by Bihar Sanskrit Siksha Board, Patna and other Educational Boards, in

Patna High Court Cr.Misc. No.51848 of 2018(3) dt.01-11-2018 2/2 connivance of postal authorities.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. He had no method or source to know that the certificates/mark-sheet or any other documents filed were fake or forged at the time of appointment. He has no criminal antecedent. He is in custody since 04.07.2018. It has been further submitted that similarly placed co-accused persons have been granted bail by another co-ordinate Bench of this Court in Cr. Misc. No. 50736 of 2018, 55665 of 2018, 49817 of 2018 and 48903 of 2018 vide order dated 24.08.2018, 20.09.2018, 01.10.2018 and 24.09.2018 respectively. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge CBI-II, Patna in connection with Special Case No. 04 of 2013, RC Case No. 3(A) of 2013.
