The petitioner seeks bail in a case registered for the offence under Sections 363, 366(A) of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the F.I.R. has been lodged after lapse of four days without explaining the plausible delay which creates doubt over the prosecution version. In fact, the victim in her statement recorded under Section 164 Cr.P.C. has stated a different story and has not disclosed the name of this petitioner,

Patna High Court CR. MISC. No.85960 of 2019(2) dt.18-01-2020 2/2 which is evident from Annexure- 2. The petitioner is rotting in custody since 24.10.2019.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Sadar (Muffasil) P.S. Case No. 537 of 2019.
