The petitioner seeks regular bail in connection with Kutumba P.S. Case No. 182 of 2017, registered for the offence punishable under Sections 170, 171, 212 of the Indian Penal Code, Sections 25(1-b)a, 26, 35 of the Arms Act and Section 17 of the CLA Act.

The allegation is regarding recovery of one country made rifle and one three-nut pistol, as also five live cartridges from the house of the petitioner.

The learned counsel for the petitioner has submitted that the petitioner is innocent and he has been falsely implicated in the present case and as far as his criminal antecedent is concerned, though he is accused in two other cases, but he is on

Patna High Court CR. MISC. No.83005 of 2019(2) dt.13-12-2019 2/2 bail in one case.

Having considered the facts and circumstances of the case and the antecedent of the petitioner, this Court had put a query to the learned counsel for the petitioner as to whether he is ready and willing to be enlarged on regular bail, after completion of a period of one year in custody, the learned counsel for the petitioner has submitted that he has got no objection. Accordingly, I deem it fit and proper to direct for release of the petitioner on bail immediately upon completion of one year custody i.e. with effect from 23.7.2019 and subject to such conditions as may be deemed fit and proper to be imposed by the learned court of CJM, Aurangabad in connection with Kutumba P.S. Case No. 182 of 2018. The present petition stands disposed of on the aforesaid terms.
