The present writ application has been filed for a direction to the Respondent No. 2, the District Magistrate, Nalanda for making enquiry with regard to irregularity done in allotment of house under the Prime Minister Housing Scheme in the Village+ P.S.+Circle -Chandi, Nalanda.

The petitioner is aggrieved from the fact that the name of the father of the petitioner appears at the BPL Sl. No.185 and he obtained five number, but despite this fact, the Indira Aawas has not been allotted in his favour. The father of the petitioner transmitted a complaint before the Respondent No.2, the District Magistrate, Nalanda, through registered post, as contained in

Patna High Court CWJC No.18165 of 2018 dt.17-09-2018 2/3 Annexure-2. Subsequently, the petitioner made a complaint before the District Public Grievance Redressal Officer, Nalanda, under the Bihar Right to Public Grievance Redressal Act, 2015, as contained in Annexure-3 and thereafter he preferred an appeal before the First Appellate Authority -cum-Divisional Commissioner, Patna, as contained in Annexure-4. In the circumstances, the petitioner prays for disposal of the writ application with a direction to the Respondent No.2, the District Magistrate, Nalanda to dispose of the application of the father of the petitioner, as contained in Annexure-2. It is submitted by learned counsel for the State that he is not having instruction whether representation of the father of the petitioner has been disposed of or not, but he further states that if the representation of the father of the petitioner has not been disposed of till date, it will be disposed of within a reasonable time frame.

Though the right of the father of the petitioner has been affected but the present writ application has not been filed by him, but in view of the confined prayer only to the extent of disposal of the representation pending before respondent authority in the interest of justice, it is expected from the Respondent No.2, the District Magistrate, Nalanda to dispose of the representation of the father of the petitioner, as contained in Annexure-2, if it has not
