The petitioner is languishing in custody since 14.11.2019 in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code. It is alleged against the petitioner that the informant being a Judicial Officer entered into an agreement with the petitioner and his wife Sashi Kala Thakur and paid Rs.29,50,000/- for purchase of a flat in an apartment, but neither the flat has been transferred not the money has been returned to the informant.
It is submitted by learned counsel for the petitioner that the petitioner is either ready to return the money or to transfer the flat in question.
Learned APP for the State submits that the petitioner
Patna High Court CR. MISC. No.84235 of 2019(2) dt.18-12-2019 2/2 is named in the FIR with specif accusation.
Considering the present stand of the petitioner, let the above named petitioner be released on bail provisionally for a period of four months, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Patna, in connection with Shastrinagar P.S. Case No.412 of 2019. The provisional bail of the petitioner will be confirmed by the learned Court below if the informant appears before the learned Court below accepts the factum of issue being reconciled.
