JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 27-02-2020 An order dated 16.11.2019 passed by the District Programme Officer (ICDS) Bhojpur, Ara, is under challenge in the present writ application, whereby the petitioner's claim for her selection as Anganbari Sewika for center no. 199 in Ward no. 2 of Hetampur, Gram Panchayat, in the district of Bhojpur, has been rejected.
2. The guidelines which govern the selection of
Patna High Court CWJC No.1077 of 2020(2) dt.27-02-2020 2/2 Anganbari Sewika, admittedly provide for remedy against the impugned order. The petitioner ought to have preferred revision before the concerned Divisional Commissioner, against the impugned order, which he has not done.
3. This application is disposed of with an observation that the petitioner shall be at liberty to question the impugned decision before the Divisional Commissioner in accordance with the procedure prescribed under the guidelines.
4. It is indicated that the petitioner shall be at liberty to seek condonation of delay in filing his revision before the Divisional Commissioner on the ground that he was pursuing his remedy before this Court.
