JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Mahila P. S. Case No.30 of 2019, disclosing offences under Sections 376(ii) (e), 506 of IPC and Section 4 of POSCO Act.

As per F.I.R. petitioner is said to be committed rape upon the informant.

Submission of the learned counsel for the petitioner is that the medical report does not support the commission of rape. She is major and allegation is of dragging the girl at the Chauraha and the same is not possible to any person to drag a major girl at the Chauraha for committing rape. Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail stating that there is specific allegation against the petitioner is of committing rape in the F.I.R. and the

Patna High Court CR. MISC. No.83124 of 2019(2) dt.21-01-2020 2/2 case is also under POSCO Act.

Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail.
