JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-12-2019 The petitioner, who is in custody since 14.11.2019 and has not been made accused earlier in similar nature of case, seeks bail in connection with Nagar (Ratanpur) P.S. Case No. 427 of 2019, dated 28.07.2019, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The petitioner is said to be the owner of the vehicle from which certain quantities of liquor is said to have been recovered.

The driver of the aforesaid vehicle said to be driving the same has been granted bail by a co-ordinate Bench of this Court vide order dated 13.09.2019 passed in

Patna High Court CR. MISC. No.82835 of 2019(2) dt.13-12-2019 2/2 Cr. Misc. No. 56801 of 2019. The other accused person of this case also has been granted bail by a co-ordinate Bench of this Court.

Considering the period of custody of the petitioner and the fact that he has not been made accused in a case of similar nature earlier, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-CumSpecial Judge, Excise Act, Begusarai in connection with Nagar (Ratanpur) P.S. Case No. 427 of 2019.

The application stands allowed.
