JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2019 This is an application for grant of anticipatory bail in connection with Chapra Town P. S. Case No. 63 of 2017 disclosing offences under Sections 406, 408, 420, 467, 468 and 471 of the IPC.
As per complaint case, on the basis of which, F.I.R. was registered. The complaint case was lodged by the complainant stating that his brother enticed him to deposit the amount in the Easy Gain Company Pvt. Ltd. and on that, he has deposited the amount and several other persons have also deposited the amount and later on, he came to know that a criminal case has been lodged on the direction of District Magistrate and then came to know that he has cheated by the Company and petitioner.
Submission of the learned counsel for the petitioner is
Patna High Court CR. MISC. No.84402 of 2019(2) dt.19-12-2019 2/2 that he is only an agent in the company as well as he has also invested in the company nor the office bearers of the company. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Saran at Chapra, in connection with Chapra Town P. S. Case No. 63 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition to co-operate in disposal of the trial.
