This application for anticipatory bail arises out of Minapur P.S. Case No. 310 of 2019 for the offence punishable under Sections 341, 323, 324, 307 and 379/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code. The occurrence, as alleged, has taken place at the residence of these petitioners. There is case and counter case for the occurrence said to have taken place on 13.06.2019. In the
Patna High Court CR. MISC. No.82464 of 2019(3) dt.17-06-2020 2/3 present case, it has been alleged that co-accused Vijay Rai had entered into the informant's house and had attempted to outrage the modesty of his sister-in-law. The informant had gone to the residence of said co-accused Vijay Rai to make complaint against hid conduct. Allegedly, all the persons, named in the First Information Report, including these petitioners, most of whom are female members, are said to have assaulted the informant and those, who had come there in his rescue. On perusal of the First Information Report, it appears that there is no such allegation against the petitioners for denying them privilege of anticipatory bail. This application is accordingly allowed.
Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur, in Minapur P.S. Case No. 310 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case
