JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Kahalgaon (Ghogha) P.S. Case No. 547 of 2019 for the offences under Sections 406, 420, 409, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel submits that on the basis of the written report of the informant, the case was registered.
It is alleged that in connection with purchase of a truck, the petitioner has promised to pay Rs. 13,01,001/- and an
Patna High Court CR. MISC. No.83097 of 2019(2) dt.21-12-2019 2/2 advance of Rs. 3,50,000/- was paid to the informant and subsequently, he issued a cheque of Rs.9,51,001/- which was dishonoured. It is further alleged that when the informant asked the petitioner to pay the remaining amount, he started abusing the informant and he demanded Rangdari tax.
Considering the aforesaid background, this Court is inclined to grant bail to the petitioner. Let petitioner, abovenamed, in the event of arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. Case No. 547 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
