In this case, the petitioner is seeking anticipatory bail in connection with Suiya P.S. Case No.89 of 2019, registered for the offence punishable under Sections 30 (a), 30 (d) and 32 of Bihar Prohibition and Excise Act. A huge quantity of Mahua flower has been recovered from Bolero vehicle, however, counsel for the petitioner submits that the petitioner is the owner of the said vehicle.

Looking to the quantity recovered, this Court is not inclined to grant bail to the petitioner.

Patna High Court CR. MISC. No.84041 of 2019(2) dt.18-12-2019 2/2 Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
