JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-06-2020 Heard Mr. Brij Bihari Tiwary, learned counsel for the petitioners and the learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Giriyak P.S. Case No. 179 of 2019 dated 21.05.2019 instituted for the offences under Sections 323, 324, 379, 506 and 34 of the Indian Penal Code.
The petitioners are stated to have assaulted the informant and also divested him of his personal
Patna High Court CR. MISC. No.87036 of 2019(3) dt.23-06-2020 2/2 belongings.
It has been submitted on behalf of the petitioners that they have been falsely implicated in this case because of ulterior motives. The injuries suffered by the victim is stated to be simple in nature.
Regard being had to the nature of accusation against the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJC-1st, Nalanda at Biharsharif in connection with Giriyak P.S. Case No. 179 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
