Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341,323,324,307,379,354,447/34 of the Indian Penal Code. The parties are agnates. Allegation against male petitioners is of commission of assault whereas the females allegedly committed theft of house hold articles including cash. Learned counsel for the petitioners submits that there is no mention of the date of occurrence in the written
Patna High Court CR. MISC. No.2375 of 2020(4) dt.17-06-2020 2/2 report and the FIR was registered on 26.09.2018 whereas the injured was examined by the Doctor on 10.12.2018 and injury report was made available on 05.07.2019. All the casual exercise were just to put a concocted case to harass the petitioners.
Finding substance in the submission aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Turkauliya (Raghunathpur) P.S.Case No. 638 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioners shall fully cooperate with the investigation/trial of the case and also the petitioners shall not leave the country without permission of the learned Trial Court, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
