This application for anticipatory bail arises out of Hathauri P.S. Case No. 168 of 2019, disclosing the offence under Section 307 and other allied Sections of the Indian Penal Code.

It is alleged that the petitioner, his full brother Sumit Kumar Jha, one Anish Singh and four others had kidnapped the informant when the informant had gone with his cousin to withdraw money from an ATM. Allegedly, they asked the informant to hand over the money which he had withdrawn from the ATM. When the informant disclosed that he had not withdrawn any money, he was assaulted by the miscreants and was thereafter took under lock and key in the house of the

Since the informant was recovered from the house of the petitioner, I am not inclined to grant him privilege of anticipatory bail.

This application is accordingly rejected.

However, the petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
