The petitioner apprehends his arrest in connection with Chandi P.S. Case No. 161 of 2018 (Excise Case No.2392 of 2018) registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that there is recovery of 13.5 liters of english wine from the straw room of the petitioner. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner and the petitioner has got no criminal antecedent. In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs.3,000/- in the Juvenile Justice Fund of the State

Patna High Court CR. MISC. No.84806 of 2019(2) dt.14-02-2020 2/2 Social Welfare Department and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of A.D.J., Bhojpur, Aracum-Special Judge, Excise Act, Bhojpur, Ara in connection with Chandi P.S. Case No. 161 of 2018 (Excise Case No.2392 of 2018), subject to the condition as laid down under Section 438(2) of the Cr.P.C.
