The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Petitioner no. 1 Dharmendra Ram is husband of the victim of murder. Murder took place after 20 years of marriage mainly for the reason that the victim was issueless. Submission is that the petitioner no. 1 wants to withdraw prayer for anticipatory bail to surrender within a period of four weeks from today.
Prayer for withdrawal of petitioner no.
Dharmendra Ram is allowed.
Other petitioners are family members.
Learned counsel for the informant opposed the prayer
Patna High Court Cr.Misc. No.56682 of 2018 (2) dt.26-10-2018 2/2 for anticipatory bail.
Considering the merit of this case, some other family members have already been allowed anticipatory bail by a Coordinate Bench of this Court vide order dated 09.07.2018 passed in Cr. Misc. No. 38880 of 2018 (Annexure 2). Hence, let the petitioner no. 2 Harihar Ram and petitioner no. 3 Bachhi Devi, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Uchakagaon Police Station Case No. 127 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner no. 2 and 3 shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner no. 2 and 3.
