JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-12-2019 The petitioner seeks bail in anticipation of his arrest in connection with Sirdala P.S. Case No. 197 of 2019, dated 09.05.2019, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 9 litres of liquor is said to have been recovered from near the river bank and one arrested accused person has named the petitioner. This is the basis of the implication of the petitioner in the instant case.

It has been submitted on behalf of the petitioner that because of the aforesaid bleak evidence and the petitioner being a person of clean antecedents, it appears that no offence under the Bihar Prohibition and Excise Act

Patna High Court CR. MISC. No.82865 of 2019(2) dt.13-12-2019 2/2 has been made out against the petitioner.

For the aforestated facts, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-Cum-Special Court, Nawada in connection with Sirdala P.S. Case No. 197 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
