The petitioner seeks bail in Araria (R.S.) P.S. Case No.456 of 2018 registered under Sections 25(1-b), 26, 27 and 35 of the Arms Act.

The informant named three persons namely Md.

Irshad, Md. Alla Noor and Md. Murshid. From the possession of Alla Noor, arms were recovered. Arms were also recovered from the motorcycle.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R.. Name of the petitioner figured in the case in the confessional statement of Md. Alla Noor who disclosed that he purchased the arms from the petitioner but

Taking into consideration that the name of the petitioner figured in the case in the confession of co-accused but petitioner was not initially named in the F.I.R., the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria (R.S.) P.S. Case No.456 of 2018.
