Earlier the application of the petitioner for grant of anticipatory bail has been dismissed vide order dated 10.05.2018 passed in Cr. Misc. No. 27437 of 2018 in connection with Wazirgang P.S. Case No. 59 of 2018, registered for offences punishable under Sections 341, 323, 307, 504/834 of Indian Penal Code.
It has been submitted by learned counsel for the petitioner that instant anticipatory bail application has been filed on the ground that co-accused of this case has been granted bail. Considering the facts and circumstances of the case, as
Patna High Court Cr.Misc. No.63108 of 2018 (3) dt.31-10-2018 the prayer of petitioner for grant of anticipatory bail has already been dismissed once on merit, I find no occasion to interfere with the earlier order dated order dated 10.05.2018 passed in Cr. Misc. No. 27437 of 2018 rather this application is disposed of with direction to the petitioner to surrender before the court below and pray for regular bail and if any such application is filed, the court below shall dispose of the same on the merit of the case and shall also consider the submission of learned counsel for the petitioner that co-accused has already been granted bail.
