JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-06-2020 Heard Mr. Arun Kumar, learned counsel for the petitioner and learned APP for the State. The petitioner, who is the younger brother of the husband of the deceased, seeks bail in anticipation of his arrest in connection with Akbarpur P.S. Case No. 301 of 2019 dated 18.07.2019 instituted for the offences under Sections 304(B)/201 and 34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that he has not been named in the FIR and after three months of the occurrence, the brother of the deceased has named him. There is no allegation against the petitioner and he has been made accused only because he happens to be the brother of the husband of the deceased. The deceased, it has been argued, has

Be that as it may, considering the nature of accusation against the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Nawadah in connection with Akbarpur P.S. Case No. 301 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
