Mr. Amit Kumar Anand ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 18-03-2020 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Dehri (T) P. S. Case No. 815 of 2017 instituted for the offence under Section(s) 307 of the Indian Penal Code and Section 27 of the Arms Act. Subsequently section 302 of the IPC was added. Specific allegations are against co-accused Rajan Singh. Having no criminal antecedents, the petitioner is in custody since 09.09.2019. It is further submitted that husband of the informant was insisting the petitioner to vacate the rented shop premises in the market owned by the informant's husband, and as such, he has falsely been implicated in the instant case. Learned APP for the State has opposed the prayer for bail.

No.83093 of 2019(3) dt.18-03-2020 2/2 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM Dehri, in connection with Dehri (T) P. S. Case No. 815 of 2017, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
