The petitioner has filed the instant application for grant of bail in a case registered for the offence under sections 341,323,307, 448,354,379,504 and 34 of the Indian Penal Code to which section 302 IPC was added subsequently. As per the allegation in the FIR, while the informant and his wife were returning from the agricultural field it is alleged that the accused persons assaulted both of them causing injury.

It is submitted by learned counsel for the petitioner that from reading of the FIR itself it would transpire that the specific allegation is against Rajnish Kumar and the allegation against the petitioner is general and omnibus in nature. The application for bail has been opposed by learned APP

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the FIR, the petitioner being in custody since 28.09.2019 and having no criminal antecedent, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Hilsa, Nalanda in connection with Tharthari P.S. Case no. 138 of 2019.
