JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 26-09-2018 Heard learned counsel for the petitioner and learned counsel for the State.

This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner for modification of the order dated 28.06.2018 passed in Cr. Misc. No.35383 of 2018 by which in the event of arrest or surrender in the court below in connection with Sheosagar P.S. Case No.16 of 2017 within four weeks, the petitioner was directed to be released on bail.

It is submitted by the learned counsel for the petitioner that the Pairvikar of the case could not intimate the petitioner regarding nature of the order passed by this Court as a result of which the petitioner was not aware that he had to surrender and furnish bail bond and sureties within four weeks. He contended

Patna High Court Cr.Misc. No.58875 of 2018 (2) dt.26-09-2018 2/2 that due to lack of knowledge, the petitioner failed to appear before the court within time and if duration of time to surrender is not extended, the petitioner may be taken into custody upon his surrender in the court.

Learned counsel for the State opposed the application for extension of duration of time for surrender before the court in order to furnish bail bond and sureties.

I have heard learned counsel for the parties. On the facts and in the circumstances of the case, the prayer is allowed. The duration of surrender mentioned in the order dated 28.06.2018 passed in Cr. Misc. No.35383 of 2018 is extended by further three weeks.
