====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-02-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Balrampur P.S. Case No. 42 of 2019 registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner abducted the minor niece of the informant. Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case inasmuch as the victim girl has been recovered and the statement of the victim has been recorded under section 164 Cr.P.C. which is Annexure-2. Relying upon Annexure-2 learned counsel for the petitioner submits that age of the niece of the

Patna High Court CR. MISC. No.85657 of 2019(2) dt.18-02-2020 2/2 informant has been disclosed by her as 19 years and she has further stated that she has performed marriage with the petitioner on her sweet will.

Having heard learned counsel for the parties and taking into consideration the fact that the victim girl has not said anything against the petitioner and she has performed marriage of her own sweet will, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Katihar in connection with Balrampur P.S. Case No. 42 of 2019, subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
