Petitioners apprehend their arrest in a case registered for the offence punishable under Section 30(a) of Bihar Excise Act.

Informant who is a police officer has alleged that on specific information that petitioners are involved in trade of illicit liquor raided their house from where son of petitioner no.1 was apprehended and on his disclosure huge quantity of country made as well as foreign liquor was recovered from the cow shed of their house. Petitioner has a criminal antecedent. Anticipatory bail petition is not maintainable and accordingly dismissed.

However, if the petitioners surrender before the court

Patna High Court CR. MISC. No.83288 of 2019(2) dt.06-01-2020 2/2 below, his regular bail application shall be considered on same day without being prejudiced by dismissal on anticipatory bail petition.
