The petitioner seeks regular bail in connection with Balia P.S. Case No. 188 of 2018 for the offence registered under Sections 30(a), 32 and 41(1) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of huge quantity of illicit liquor from a maize field.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that the maize field does not belong to the petitioner. Lastly, it is submitted that the said maize field is stated to be belonging to the co-accused person, namely, Bhola Kumar @ Bhola Mahto who has already been granted

Patna High Court CR. MISC. No.84629 of 2019(2) dt.19-12-2019 2/2 bail by an order dated 10.04.2019 passed in Criminal Misc. No. 14282 of 2019. The petitioner is stated to be languishing in custody since 08.11.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-IInd-cum-Special Judge, Excise Act, Begusarai in connection with Balia P.S. Case No. 188 of 2018.
