JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Barauni (Chakia) P. S. Case No. 326 of 2017 registered for the offences punishable under Sections 307, 376, 511, 34 of the Indian Penal Code and Section 27 of the Arms Act.

There is specific allegation against the petitioner that he along with others made attempt to commit rape on the informant and when he as well as his associates failed to fulfill their lust, the petitioner opened fire causing injury to the informant.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to extend the
