ANJANA MISHRA ORAL ORDER 11-12-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Rajepur P.S. Case No.87 of 2016 for allegedly having committed the offences under Sections 147, 148, 149, 144, 153A, 153B, 295, 297, 353, 505, 452, 380, 307, 323, 324, 431, 341, 342, 427, 188, 337, 120B of the Indian Penal Code, Section 27 of the Arms Act and Section 3⁄4 of the Prevention of Damages to Public Property Act, 1984.

Learned counsel for the petitioners submits that the entire allegation is false and fabricated and they have been implicated in connection with the present case on the allegation

Patna High Court Cr.Misc. No.63028 of 2018(2) dt.11-12-2018 2/2 of stone pelting on the police personnel and public administration and have been accused of mob violence. It is further submitted that several other similarly situated persons have since been extended the privilege of pre-arrest bail in Cr. Misc. No.17746 of 2018, vide order dated 09.04.2018 (Annexure 2).

Considering the aforementioned facts and circumstances and that the names of these petitioners have surfaced during the course of the investigation, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sadar, East Champaran, Motihari, in connection with Rajepur P.S. Case No.87 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
