JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 21.02.2019 in connection with Barahiya P.S. Case No. 292 of 2018 registered for the offences punishable under Sections 307/34 of the Indian Penal Code and 25(1-B)a, 26, 27, 35 of the Arms Act. The alleged recovery is said to have been made from DALAN of house of the petitioner but admittedly, petitioner was not caught on the spot. No doubt, petitioner carries criminal antecedent of eleven cases but in the present case, the alleged recovery has not been made from his conscious possession. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above
