The petitioner seeks bail in Siwaipatti P.S. Case No. 53/2018, instituted for the offences under Sections 341, 342, 324, 325, 307 and 120(B)/34 of the Indian Penal Code. It is alleged in the written report that when the informant was going to the house of his uncle, co-accused Munna Paswan forcibly sat upon his motorcycle at Banghara Chowk and asked to carry him to Sunder Devi Asthan. It is further alleged that when the informant reached at Sunder Devi Asthan, petitioner and one Rakesh Paswan were present there, who forcibly took the informant in the field of Uday Pandit and tried to kill him by gun shot, which did not hit him. Then accused persons assaulted the
Patna High Court Cr.Misc. No.65596 of 2018 (2) dt.05-11-2018 2/2 informant with butt of gun and knife causing injury on his head. Injury report is annexed as Annexure-2, wherein doctor has found cut injuries on the scalp.
Petitioner is in custody since 07.07.2018.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate IXth, Muzaffarpur in connection with Siwaipatti P.S. Case No. 53/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
