The petitioner seeks regular bail in connection with Supaul PS case no. 649 of 2019 instituted for the offence punishable under Sections 420, 409 of Indian Penal Code. The allegation is regarding the informant and other government officials having inspected the godown where the petitioner is stated to have been posted as Assistant Godown Manager and upon preparation of inventory, it was found that 1393.99 quintals of rice had been misappropriated. It is further submitted that the petitioner is having a clean antecedent and has deep root in the society and is not likely to flee away from the investigation or from the ensuing trial. It is further submitted that charge sheet has already been filed in the present case, hence there is no requirement of custodial investigation. Lastly, it is submitted that the petitioner is languishing in custody since 27.09.2019. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the petitioner is having a clean antecedent and charge sheet has already been filed in the present case, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul PS case no. 649 of 2019.
