2. The petitioner seeks bail in a case registered for the offence under Sections 121, 379, 414, 120B/34 of the Indian Penal Code , Sections 25(1-a), 25(1-aa), 25(1-b)a, 26, 35 of the Arms Act and Section 39 of the UAP Act.

3 . As per the prosecution case , on the basis of confessional statement of co-accused Md. Shamsher, wherein , he stated that this petitioner was one of his associates in hiding the bag containing five AK 47 rifle .

4. It is submitted on behalf of petitioner that petitioner is not named in the F.I.R., and his name transpired in this case only on the basis of confessional statement of co-accused persons. No incriminating article was recovered from the possession of this petitioner and he has got no concern with the aforesaid occurrence . Similarly situated co-accused persons

Patna High Court CR. MISC. No.2110 of 2025(7) dt.01-08-2025 2/2 has already been granted bail by this Court vide order dated 24.03.2022 in Cr. Misc. No. 36277 of 2021 and Co-ordinate Bench of this Hon'ble Court dated 22.03.2021 in Cr. Misc. No. 35803 of 2020. Petitioner is in custody since 24.11.2022 . 5 . Learned A.P.P. for the State has opposed the bail petition .

6. Considering the aforesaid facts and circumstances as well as period of custody , tardy progress of trial, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional sessions Judge Munger vide ST Case No. 215 of 2021 arising out of GR No. 2824 of 2018 . in connection with Mufassil P.S.
