The petitioners seek bail in anticipation of their arrest in connection with Raniganj P. S. Case No. 169 of 2018 dated 16.06.2018 instituted for the offences under Sections 147, 148, 341, 323, 379, 354(B), 325, 307, 506 and 120 (B) of the Indian Penal Code.

No.87386 of 2019(3) dt.25-06-2020 2/3 It has been alleged in the F.I.R. that while the informant and his daughter were moving on motor-cycle on a road, he found that half the road had been covered by maize grains belonging to the petitioners. Because of the informant passing through the aforesaid road on a motor-cycle, a scuffle took place, in which the informant is alleged to have been assaulted. The assault perpetrated by petitioner no. 2 hit him in his ankle. Later, an injury report by a private doctor was produced which indicated that the injury was grievous in nature. An attempt also, it has been alleged, was made for outraging the modesty of the daughter of the informant.
From the narration made in the F.I.R., it appears that the occurrence arose out of a trifle. There is no premeditation and the manner in which the occurrence took place depicts that it was under a flash of tamper because of some dispute.
The petitioners are persons of clean antecedents. Regard being had to the aforesaid facts, the petitioners, above-named, are directed to be released on

No.87386 of 2019(3) dt.25-06-2020 3/3 bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Araria in connection with Raniganj P. S. Case No. 169 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
