2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 406, 420, 467, 468, 471/34, 384, 386, 387, 504, 120(B) of the IPC. 3 . The case of the prosecution, in brief, is that this petitioner namely Manali Bharti and other co-accused person took the part of complainant house on rent at the rate of rupees 65,00/ per month to open a shop and a rent agreement was also made and later on they stopped paying the rent and executed a
Patna High Court CR. MISC. No.1358 of 2026(6) dt.22-06-2026 2/3 Jarbayana cum Sale-deed for Rs. 61,00,000/- and received Rs. 31,35,000/-. It is also alleged that they have forcefully made the complainant sign the stamp paper on the point of gun in the name of this petitioner.
4. It is submitted on behalf of the petitioner that petitioner is quiet innocent and has committed no offence as alleged. Both the parties have filed Title Suit with respect to same property which is pending before the learned Court below i.e,. Title Suit No. 488 of 2020 is filed by petitioner whereas Title Suit No. 873 of 2022 is filed by O.P. No. 2. The dispute involved in this case is purely civil in nature. Petitioner claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the fact that the dispute involved in this case is purely civil in nature, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class, Saharsa in connection with Complaint Case No. 53c of 2021,
