This application is for grant of regular bail in connection with Muzaffarpur Sadar P.S.Case No.630 of 2019 Dated 10.9.2019 G.R.No.5036 of 2019 for the offences under Sections 393 of the Indian Penal Code.

As the prosecution case in short is that while the informant was going by motorcycle , four person came on the tempo and tried to snatch the motorcycle of the informant, who raised hulla then the petitioner and other accursed persons persons were arrested on the spot .

Submission of the learned counsel for the petitioner is that as a matter of fact the tempo has dashed the motorcycle; for the same some scuffle took place and they have

Patna High Court CR. MISC. No.83262 of 2019(2) dt.16-12-2019 2/2 been falsely implicated in this case. He has no criminal incident. He is in custody for three months. Charge sheet has been submitted.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, if the charges are framed in this case the petitioner is at liberty to renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
