The petitioners, who are in custody, seek bail in connection with Warisaliganj P.S. Case No. 207 of 2018 registered for the offences punishable under Section 147, 148, 149, 341, 323, 307, 302 of the Indian Penal Code and Section 27 Arms Act.

Informant has alleged that when he along with his nephew went to the land for irrigation then petitioners along with other F.I.R. named accused persons came there with deadly weapons and fired upon informant and his nephew Ranjeet Kumar as a result of which informant sustained fire arm injury and his nephew Ranjeet Kumar died.

They have been falsely implicated in this case due to drainage disputes between the both parties. Petitioners have no criminal antecedent and are in custody since 26.06.2018. Considering the allegation against the petitioner, I am not inclined to enlarge the petitioners on bail. Hence, the prayer for bail of the petitioners is hereby rejected. However, after one year of the custody the petitioners would be at liberty to renew their prayer for bail. (S. Kumar, J) Rajiv/- U T
