JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-12-2019 The petitioner, who is the mother-in-law of the deceased, seeks bail in connection with Babubarhi P.S. Case No. 178 of 2019, dated 22.08.2019, which though was instituted for the offences under Sections 304(B) and 34 of the Indian Penal Code, but the charge-sheet in this case has been submitted under Section 306 of the Indian Penal Code. There is no specific accusation against the petitioner in the F.I.R. and the husband of the deceased is in custody.

It has been submitted on behalf of the petitioner that because of the husband of the deceased having gifted a mobile telephone to his sister, the deceased, a person of

Patna High Court CR. MISC. No.82838 of 2019(2) dt.13-12-2019 2/2 fragile sensibilities, committed suicide.

Considering the gender of the petitioner and the period of her custody, she is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Madhubani in connection with Babubarhi P.S. Case No. 178 of 2019.

The application stands allowed.
