JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 Earlier the prayer for bail of the petitioner was dismissed vide order dated 17.10.2017 passed in Cr. Misc. No. 47084 of 2017 with direction to the trial court to conclude the trial within a period of six months and liberty was given to the petitioner that if the trial is not concluded, he may renew his prayer for bail.

Allegation against the petitioner is that the police personnel asked him to stop the vehicle but he did not stop the vehicle and ran over a constable of the police causing injury to him, who later on succumbed to the injuries.

Submission of learned counsel for the petitioner that in spite of direction of this court to the trial court to conclude the trial within a period of six months, the same has not been concluded and uptil now only two witnesses have been examined and there is no likelihood of conclusion of trial in

Patna High Court Cr.Misc. No.68003 of 2018(3) dt.20-12-2018 2/2 near future and petitioner has been in judicial custody since 17.07.2017.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -I, Jamui, in connection with Chandramandih P.S. Case No. 46 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
