The petitioners seek bail in anticipation of their arrest in connection with Shakurabad P. S. Case No. 102 of 2016 instituted for the offences under Sections 341, 323, 452, 354(A), 354(B), 366(A), 511, 504, 506 and 34 of the Indian Penal Code and Section 8 of the POCSO Act, 2012. The allegation in the F.I.R. is basically against local Mukhiya who along with others had made attempts of kidnapping the minor daughter of the informant. Later, the Mukhiya is said to have sent the petitioners and Md.
Patna High Court Cr.Misc. No.66698 of 2018(2) dt.17-12-2018 2/3 Taufique to the house of the informant where all of them assaulted him.
Learned counsel for the petitioners has drawn the attention of this Court to the fact that Md Taufique who is similarly situated as that of the petitioners has been granted anticipatory bail by a Bench of this Court vide order dated 31.01.2017 passed in Cr. Misc. No. 3098 of 2017. The allegations against the petitioners are very vague and general in nature.
The petitioners do not have any criminal antecedents.
Considering all the above-stated facts, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of 2018 receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-I, Jehanabad in connection with Shakurabad
