2. The petitioner seeks regular bail in connection with Buxar Town P.S. Case No. 283 of 2023 registered for the offence under Sections 21, 22, 27 of the N.D.P.S. Act, 1985.

3. As per the prosecution case, there is recovery of 50 gram of heroin.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. The petitioner is in custody since 29.05.2023.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. In the trial out of six witnesses, four witnesses have been examined.

7. Considering the facts and circumstances of the case, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd, Buxar/concerned Court below in connection with Buxar Town P.S. Case No. 283 of 2023 subject to condition that:- (i) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife.

(ii) The petitioner will mark his attendance at the Buxar Police Station on the every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner.

(iii) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bonds of the petitioner.

9. This application for regular bail stands allowed. (Sandeep Kumar, J) anand/- U T
