Mr. Smt Indu Kumari Srivastava ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-12-2018 The petitioner seeks bail in connection with Gandhi Maidan P.S.Case No. 21 of 2017 registered under Section 392 of the Indian penal Code.

Allegation, as per the FIR, is of theft of a Scooty and Rs. 60,000/- was kept in the dickey of the Scooty. The FIR is against unknown. Later on, name of the petitioner transpired during investigation.

Submission of learned counsel for the petitioner is that except confessional statement of co-accused, there is no other material against the petitioner even no recovery has been made from him and though he is accused in five other cases but in all he is on bail and in this case, petitioner is in custody since 10.01.2018.

Heard learned APP also.

No.68010 of 2018(3) dt.04-12-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM(vi), Patna in connection with Gandhi Maidan P.S. Case No. 21 of 2017 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
