Petitioner seeks bail in Beur P.S. Case No. 154 of 2018 registered for the offence punishable under Sections 302, 120/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of killing the son of the Informant along with FIR named accused. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. It has been further submitted that Informant is not the eye witness. There is allegation of firing against Golu Sonar. Similarly, situated co-accused person has been granted bail by a coordinate bench of this Court vide order dated 06.10.2018 in Criminal Miscellaneous No. 60413 of 2018. Petitioner is in

Patna High Court Cr.Misc. No.66671 of 2018(3) dt.26-11-2018 2/2 custody since 28.05.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub Judge VIII cum ACJM VIII, Patna, in connection with Beur P.S. Case No. 154 of 2018, with following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioners shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
